ABSTRACT 

Article 7 (1), Article 22 paragraph (1) and Article 39 paragraph (1) of Regulation Plan 2016 resulted in Surabaya Mayor. This problem is the inclusion of the terms "religion" because it may cause double interpretation. This condition is also contrary to Article 19 of the Regulation of the Minister of Home Affairs Number 5 Year 2007 on Guidelines for Community Planning Board which include the phrase "citizen of the Republic of Indonesia" as a condition. The conclusion is that the draft regulation on the Mayor of Surabaya in 2016 contrary to the Regulation of the Minister of Home Affairs Number 5 Year 2007 on Guidelines for Planning Community Institutions, Article 18B paragraph (2) of the Constitution of the Republic of Indonesia Year 1945 and Article 5 of the letter of the Law of the Republic of Indonesia Number 12 Year 2011 concerning Establishment of Legislation. On behalf of the design draft regulation Mayor of Surabaya in 2016 in order to have a willingness to understand the primary purpose of the legislation is legal justice.
